Rental conversions in Dover

Cost vs. Value's 2025 report put a new detached accessory unit at $165,5361 in Philadelphia, the closest market it covers, against $166,4062 nationally. The bigger local factor is which side of the city line the house is on: unincorporated Kent County allows one accessory dwelling unit per property in every residential zone as long as the owner lives on site, while inside Dover, where 53%3 of occupied homes are already rented, every rental unit needs an annual city permit and an inspection before the first one is issued.

Renters and rents on both sides of the city line

Two Census measures for Kent County and the capital at its center: the slice of occupied homes held by tenants, and what the middle tenant pays each month including utilities.

MeasureKent CountyCity of Dover
Occupied homes rented by their occupants27%353%3
Median gross rent, per month$1,3544$1,3444

More than half of the homes in the city are rented, against a much smaller share across the county, yet the median rent is almost the same in both. Check what comparable units nearby actually rent for before you borrow against the house.

Townhouses, small buildings and detached houses

Census shares of homes by the kind of building they are in. Attached homes and two-to-four-unit buildings are both more common inside the city.

MeasureKent CountyCity of Dover
Homes in buildings with two to four units3%56%5
One-unit attached homes (townhouses and twins)9%515%5
Single-family detached houses65%540%5

Outside the city, detached houses on their own lots dominate, which is the kind of property Kent County's accessory unit rules were written for. Inside Dover, a unit added to a house is treated as a multiple-family rental under the city's rental code.

Small homes are scarce outside the city

Census counts of homes by number of bedrooms. An accessory unit is usually a studio or a one-bedroom.

MeasureKent CountyCity of Dover
Homes with one bedroom or none7%616%6
Homes with two bedrooms19%630%6

Homes with one bedroom or none are a thin slice of the county's housing, so a compact unit outside the city adds a kind of home that is hard to find there, whether it goes to a tenant or to a parent.

The city does follow up: its code enforcement office opened cases against rentals operating without a valid permit. Get the permit before the first tenant moves in.

The closest published prices

Cost vs. Value's 2025 Philadelphia page prices a new detached accessory unit and the pieces an attached apartment is often built from.

MeasurePhiladelphiaU.S. average
Accessory dwelling unit (new detached build), job cost$165,5361$166,4062
Accessory dwelling unit (new detached build), resale value$63,8361$68,6562
Bathroom addition, midrange, job cost$63,1201$60,6458
Minor kitchen remodel, midrange, job cost$28,1301$28,4582

A detached unit costs about the same in Philadelphia as nationally but adds less at resale there, so it has to pay its way in rent or family use. Converting space inside the house usually means a bath and a modest kitchen rather than a whole building.

House age and lead-safe work

The decade a house was built decides which lead rules apply to the work. Census shares by year built:

EPA's lead renovation rule generally doesn't cover homeowners working on their own pre-1978 homes, but it does apply if you rent out all or part of your home.10 Delaware runs its own lead renovation program: firms and workers doing renovation, repair or painting in pre-1978 housing that disturbs more than six square feet of painted surface in a room, more than twenty square feet outside, or that replaces windows or demolishes, must be certified by the Division of Public Health.11

Permits

A conversion clears zoning first, then construction permits, then rental licensing. In unincorporated Kent County an accessory dwelling unit is allowed in residential zones once the owner-occupancy declaration is recorded and full plans are filed, while incorporated towns with their own code, such as Harrington, write their own rules. Inside Dover the new unit needs building and plumbing permits from the city and then a rental permit, with an inspection before the first one is issued.

  • Kent County's accessory dwelling unit chapter, adopted in 2023, permits ADUs in all residential zones, subject to other regulations and building codes, and limits each property to one ADU, attached or detached.12
  • In Kent County, one dwelling unit on a property with an ADU must be owner-occupied, and a notice and declaration of land use restriction saying so must be signed and recorded before the county issues a certificate of use or building permit for the ADU.12
  • A Kent County ADU application must include full building plans for the new structure or the addition or renovation, a separate floor layout of all finished levels, the use of each room, and all entrances and exits.12
  • Kent County's building permit law doesn't apply inside incorporated cities and towns that adopt and enforce their own building code and permit procedures.13
  • No one may operate a single-family rental dwelling in the City of Dover without a permit from the licensing division of the Department of Planning and Inspections; the permit expires each January 31, and multiple-family dwellings need an annual permit too.14
  • The City of Dover's code enforcement office inspects rental dwellings for compliance with the property maintenance code, an inspection is required before any new rental dwelling permit is issued, and the owner or property manager must be present.14
  • City of Dover permit applications are filled out by a contractor licensed in the City of Dover, or by the homeowner or property owner with the contractor's information.15

Kent County's accessory dwelling unit rules

Kent County's accessory dwelling unit chapter, adopted in 2023, permits ADUs in all residential zones, subject to other regulations and building codes, and limits each property to one ADU, attached or detached.12 In Kent County, one dwelling unit on a property with an ADU must be owner-occupied, and a notice and declaration of land use restriction saying so must be signed and recorded before the county issues a certificate of use or building permit for the ADU.12

A Kent County ADU may not exceed half of the main dwelling's floor area, though square footage needed to meet accessibility standards doesn't count toward that limit, and total impervious cover on the lot is capped at 50 percent.12 A detached ADU in Kent County must sit behind the main house, keep at least half of the house's side and rear setbacks, and be built on a slab or crawl space; basements are not permitted.12

Kent County does not allow manufactured homes to be used as ADUs, and a dwelling served by an on-site wastewater system cannot be modified to create an ADU until DNREC issues a permit for it.12 On a septic lot, line up that DNREC approval first; a second kitchen and bath mean more water through the same tank and drain field.

Towns that write their own rules

Kent County's building permit law doesn't apply inside incorporated cities and towns that adopt and enforce their own building code and permit procedures.13 The City of Harrington, a Kent County town with its own ADU chapter adopted in 2025, requires the owner to live in either the main house or the ADU, lists rental units as prohibited, and bars selling an ADU separately.16

So if your address is inside one of the county's incorporated towns, start at that town hall rather than the county office, and ask whether a unit may be rented at all.

Adding a rental unit inside Dover

Dover's rental code counts apartments, rooming houses, condominium units and accessory apartments inside owner-occupied houses as multiple-family dwellings, and detached houses, mobile and manufactured homes, duplexes and townhouses as single-family dwellings.14 The zoning pages we could read didn't settle where the city allows a second unit in a house, so ask the planning office whether your zone permits one before paying for drawings.

No one may operate a single-family rental dwelling in the City of Dover without a permit from the licensing division of the Department of Planning and Inspections; the permit expires each January 31, and multiple-family dwellings need an annual permit too.14 The City of Dover's code enforcement office inspects rental dwellings for compliance with the property maintenance code, an inspection is required before any new rental dwelling permit is issued, and the owner or property manager must be present.14

A Dover rental owner who lives outside Kent County must have a licensed property manager, or a family member or other designated person, living or keeping an office in the county who can give inspectors access.14 Book the city's rental inspection only after the building, plumbing and electrical inspections are closed, because the code officer will look at the same alarms, exits and outlets.

Short-term rentals

In the City of Dover, a short-term rental (a stay of less than 30 days) is allowed in a one-family dwelling where that use is allowed by right, but the owner needs an annual short-term rental use license, renewed by January 31, and a code enforcement inspection before the first license.14 Dover limits a short-term rental to two guests aged 12 or older per bedroom and twelve occupants in all, one extra vehicle per bedroom up to six, and requires guests to have access to a full bath.14

Delaware charges a 4.5 percent short-term lodging tax on the rent for a house, apartment or other dwelling rented to guests for no more than 31 consecutive nights, and anyone in the business of offering such rentals to the public needs a Delaware business license.17 Delaware exempts an owner's casual rental arranged directly with the guest when the property is rented for no more than 10 nights in total in a calendar year.17

A new unit near the air base

Kent County's Airport Environs Zoning Overlay around Dover Air Force Base requires buildings constructed or placed in its noise zones to have acoustical treatment cutting outdoor-to-indoor noise by 25 to 40 decibels depending on the zone, certified by a Delaware-accredited architect or engineer.18 A detached cottage is a new building, so if your lot is inside the overlay, ask the county whether the sound standard applies before the plans are drawn. Kent County must tell permit applicants when a property is in the Airport Environs overlay and subject to overflights, noise and sound-attenuation rules, and the same notice language must appear in deeds and leases for affected land.18 That notice belongs in the lease you give a tenant as well.

Alarms, exits and lead

Dover's amendments delete the residential code section that calls for automatic fire sprinkler systems in houses.14 That doesn't remove the need for a fire-rated separation between two units, a way out of each one and working alarms, so ask the company which code edition the permit office enforces. The U.S. Fire Administration says homeowners and landlords should put smoke alarms in every bedroom, outside each sleeping area and on every level, test them monthly, and replace them 10 years from their manufacture date.19

Before a renter signs a lease for most pre-1978 housing, federal law requires the landlord to disclose known lead-based paint and hazards, share available records, hand over EPA's Protect Your Family From Lead pamphlet and include a Lead Warning Statement.20 With 35%9 of county homes built before 1980, plan on lead-safe work in most older houses until a test shows otherwise.

A unit for a parent

Plenty of conversions around Dover end up housing a mother or father rather than a tenant; 33%321 of the county's owner households are already headed by someone sixty-five or older. Kent County leaves the space needed for accessibility standards out of its size limit, so a wider door, turning room and a curbless shower don't eat into the allowed floor area. NAHB's Certified Aging-in-Place Specialist (CAPS) credential trains remodelers in home modifications for aging in place.22

Questions people ask

Can I add an accessory unit to my house in Kent County?

In unincorporated Kent County, yes, in any residential zone and one per property. In Kent County, one dwelling unit on a property with an ADU must be owner-occupied, and a notice and declaration of land use restriction saying so must be signed and recorded before the county issues a certificate of use or building permit for the ADU.12 Inside an incorporated town, read that town's code first.

Do I need a rental permit in Dover?

Yes, for every rental unit inside city limits.

Can I rent the unit short-term?

Inside the city, only with a license. In the City of Dover, a short-term rental (a stay of less than 30 days) is allowed in a one-family dwelling where that use is allowed by right, but the owner needs an annual short-term rental use license, renewed by January 31, and a code enforcement inspection before the first license.14 Delaware charges a 4.5 percent short-term lodging tax on the rent for a house, apartment or other dwelling rented to guests for no more than 31 consecutive nights, and anyone in the business of offering such rentals to the public needs a Delaware business license.17

Does lead paint matter for a rental conversion?

In an older house, yes.
